Overview

This website, elementflooring.us (the "Site"), is operated by Element Flooring ("Element Flooring," "we," "us" or "our"). These Terms of Service ("Terms") govern your access to and use of the Site and any purchase you make from us. By visiting the Site or placing an order, you agree to these Terms. If you do not agree, please do not use the Site.

These Terms include, and should be read together with, our Return & Refund Policy, Shipping Policy, Privacy Policy and Warranty. If anything in these Terms conflicts with one of those policies, the specific policy controls for its subject.

1. Eligibility

You must be at least the age of majority where you live to place an order on the Site. By placing an order, you confirm that the information you provide is accurate and that you are authorized to use the payment method you submit.

2. Products and Product Information

We try to display our flooring as accurately as possible. Wood and other flooring materials are natural or naturally inspired products, and color, grain, shade and texture vary from plank to plank, from lot to lot, and from what you see on a screen. Photos, descriptions and samples are representative, not exact. We strongly recommend ordering samples before purchasing.

We do not warrant that product descriptions, specifications or other content on the Site are complete, current or error-free. We may change or discontinue products at any time without notice.

3. Pricing and Payment

All prices are listed in U.S. dollars and are subject to change without notice. Prices do not include applicable taxes unless stated. Occasionally the Site may contain pricing, typographical or availability errors. We reserve the right to correct any error and to cancel any order placed at an incorrect price, even after an order confirmation has been sent. If your payment has already been processed for an order we cancel, we will refund it in full.

Payments are processed through Shopify and our third-party payment providers. You agree to pay all charges incurred on your order, including freight and taxes where applicable.

4. Orders and Cancellations

Your receipt of an order confirmation does not mean we have accepted your order. We may refuse, limit or cancel any order, including orders we suspect are fraudulent. Order cancellations requested by you are handled as described in our Return & Refund Policy, which may include a cancellation fee.

5. Shipping, Delivery and Risk of Loss

Orders ship by freight carrier as described in our Shipping Policy. You are responsible for being available to receive your delivery, for unloading as described in that policy, and for inspecting your shipment at delivery. Any visible damage must be noted on the delivery paperwork before signing; otherwise the carrier may deny a damage claim. Additional charges for redelivery, storage or special services may be added to your order as described in the Shipping Policy. Delivery dates are estimates only.

6. Returns and Refunds

Returns and refunds are governed by our Return & Refund Policy. All returns require a Return Authorization (RA) number issued by us before the product is sent back.

7. Installation

You are responsible for ensuring that flooring is inspected before installation and installed properly, in accordance with our installation instructions and applicable building codes. Installation is considered acceptance of the material in the condition it was received. Improper installation, site conditions and failure to follow care instructions may void warranty coverage.

8. Warranty

Products are covered only by the written limited warranty described on our Warranty page, subject to its terms, conditions and exclusions. No employee, agent or third party is authorized to change or extend that warranty except in writing signed by an authorized officer of Element Flooring.

9. Accounts

If you create an account on the Site, you are responsible for keeping your login credentials confidential and for all activity under your account. Please notify us promptly of any unauthorized use.

10. Reviews and Submissions

If you submit reviews, photos, comments or other content to us or on the Site, you grant Element Flooring a non-exclusive, royalty-free, perpetual license to use, reproduce, edit and publish that content in connection with our business. You confirm that your content is accurate, is your own, and does not violate any law or anyone else's rights. We may remove any content at our discretion.

11. Intellectual Property

All content on the Site, including text, images, logos, graphics and product photography, is owned by or licensed to Element Flooring and is protected by intellectual property laws. You may not copy, reproduce or use Site content for commercial purposes without our written permission.

12. Prohibited Uses

You agree not to use the Site for any unlawful purpose; to interfere with the Site's security or operation; to upload viruses or malicious code; to scrape or collect data from the Site by automated means; or to impersonate any person or misrepresent your affiliation with anyone.

13. Third-Party Links and Services

The Site may include links to, or tools provided by, third parties (for example, payment, financing, visualization or review services). We are not responsible for third-party websites or services, and your use of them is subject to their own terms and policies.

14. Disclaimer of Warranties

Except for the written limited warranty described on our Warranty page, the Site and all products and services are provided "as is" and "as available," without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement, to the fullest extent permitted by law.

15. Limitation of Liability

To the fullest extent permitted by law, Element Flooring and its owners, employees and agents will not be liable for any indirect, incidental, special, consequential or punitive damages, including installation or labor costs, lost profits or loss of use, arising from your use of the Site or any product. Our total liability for any claim relating to a product will not exceed the amount you paid for that product. Some jurisdictions do not allow certain limitations, so some of these limitations may not apply to you.

16. Indemnification

You agree to indemnify and hold harmless Element Flooring and its owners, employees and agents from any claims, losses or expenses, including reasonable attorneys' fees, arising from your breach of these Terms or your violation of any law or the rights of a third party.

17. Governing Law

These Terms are governed by the laws of the State of California, without regard to its conflict-of-law rules.

18. Changes to These Terms

We may update these Terms from time to time. Changes take effect when posted on the Site, and the "Last updated" date above will be revised. Your continued use of the Site after changes are posted means you accept the updated Terms.
